A purchaser is entitled to conduct a land search before the purchase price is paid. Of the two types of land searches; Private Land Search and Official Land Search; only an Official Land Search provides the purchaser with a certificate with the Land Registrar stamp and officer’s signature. The details and records obtained from a land search can then be used to draft representations, warranties and/or additional clauses in sale and purchase agreements. As such, a land search protects the purchaser's interest and mitigates the possibility of land disputes in the future.

 

Land searches can only be conducted in-person at a Land Office in the location that the title was issued. In order to conduct a land search, the following information is necessary:
  • Title type
  • Title number
  • Lot number
  • Bandar/Pekan/Mukim, and state

If this information is not available to you, the seller's solicitor should be consulted to obtain the particulars of the land in question.

 

Once a land search has been requested, it can take anywhere a few days to a few weeks to hear back from the Land Office. The information that you can obtain from a land search includes:
  • Particulars of the title; such as title number, lot number, bandar/pekan/mukim, and state
  • Particulars of the seller/owner; such as name and identification number to verify that the property belongs to the seller
  • Status of the title; i.e. freehold or leasehold
  • Charge as it is important to determine if the land/property is charged to a bank/financier
  • The existence of any caveats that prevent any dealings with the property to secure someone's interest in it. You may need an attorney to remove such a caveat
