A purchaser is entitled to conduct a land search before the purchase price is paid. Of the two types of land searches; Private Land Search and Official Land Search; only an Official Land Search provides the purchaser with a certificate with the Land Registrar stamp and officer’s signature. The details and records obtained from a land search can then be used to draft representations, warranties and/or additional clauses in sale and purchase agreements. As such, a land search protects the purchaser's interest and mitigates the possibility of land disputes in the future.
