Business Licenses & Special Permits

When you set up a company in Malaysia, you will require the following fundamental licenses according to what is applicable and suits your business needs:

GENERAL LICENSES are compulsory licenses that you will need to open a business in Malaysia. These include:
  • Company registration (under a company secretary)
  • Company and employee income tax files with the Inland Revenue Board (IRB) of Malaysia as well as registrations with the Employees Provident Fund (EPF), Social Security Organisation (SOCSO), and Human Resources Development Fund (HRDF)
  • Business premises licenses and signboard licenses
  • Sales and Service Tax (SST)
  • Ministry of International Trade and Industry (MITI) License
    (only for eligible manufacturing companies)
  • Ministry of Finance (MOF) License
    (for e-perolehan, if eligible)

 

ACTIVITY-SPECIFIC LICENSES apply to more than one industry or sector. There are a set of specific guidelines in place to protect the interests of the citizens and employees as well as the safety of the employees, environment, and members of the public.
Activity-specific licenses include:
  • Factory and Machinery, Certificate of Permission to install and Certificate of Fitness (from the Department of Occupational Safety & Health (DOSH) Malaysia)
  • Approval of expatriate posts (from the Expatriate Services Division (ESD) Malaysia)
  • Approval to install, respite or alter air pollution control equipment (from the Department of Environment (DOE) Malaysia)
  • Building plan approval (from the Town Council)
  • Sales tax license (from the Royal Malaysian Customs Department)
  • Fire brigade approval (from Fire and Rescue Department of Malaysia)
  • CIDB License (from Construction Industry Development Board (CIDB) Malaysia)
  • License Manufacturing Warehouse (LMW) – (from the Royal Malaysian Customs Department)
  • Temporary Occupation License (from the Land Office)
Special Activity Permits:
  • Special MITI Permit to operate during the Covid-19 Movement Control Orders (MCOs)
